Auction for the Grant of the Right to Use Radio Frequency Spectrum for the Establishment and Operation of a Commercial Digital Terrestrial Television Network for the Provision of Electronic Communications Services (reference code: THE Δ2/2024)
Offering of the Radiocommunication Authorisation
1. In accordance with Regulation 9(4)(a) of the Radiocommunications (Competition and Negotiation Procedures) Regulations 2002, as amended, in the event that the number of selected applicants for participation in the auction process (qualified bidders) is equal or less than the number of the individual rights to use radio frequencies (Radiocommunications Authorisations) to be granted, no auction is held, and the Director may, in accordance with Regulation 25 (6)(a), proceed with a negotiation procedure, following a relevant decision of the Deputy Minister of Research, Innovation and Digital Policy pursuant to Regulation 7(2)(a), that is to negotiate with the selected applicants the right of use fee that they will pay, which cannot be lower than the starting price of the Auction, for the period of validity of the individual rights of use to be granted, which is specified in the tender documents.
2. According to the above, the Deputy Minister of Research, Innovation and Digital Policy has decided to implement the negotiation procedure with the company Hellas Sat Consortium Ltd, the only qualified bidder in relation to the said tender.
3. The negotiation procedure with the company Hellas Sat Consortium Ltd has been successfully completed and therefore the Director of the Electronic Communications Department offers the said company the Radiocommunication Authorisation, which will be granted if the specific requirements are satisfied within thirty (30) days from the date of this announcement, in accordance with the provisions of paragraph 37.1 of the Tender Documents. The fee for the Radiocommunication Authorisation has been agreed at €500.000 (five hundred thousand euro) for two (2) multiplexes with national coverage.
4. Also, according to paragraph 36.2 of the Tender Documents, the company has the possibility to request the inclusion in the Radiocommunications Authorization of up to two (2) additional multiplexes with national coverage (in addition to those mentioned in paragraph 3 above). Each additional multiplex with national coverage will have an additional authorization fee of €225.000 (two hundred twenty-five thousand euros).
